Alabama Field Sobriety Test Attorneys

The tests by which law enforcement evaluate your level of intoxication can often be influenced by a variety of circumstances. From weather conditions to physical injuries, there are many factors that can throw off the officer's assessment of your intoxication.

Field sobriety tests are used to determine if there is probable cause to administer a Breathalyzer test to an individual that is suspected of being intoxicated. These tests generally revolve around the following main three requests:

Horizontal gaze — You will be asked to follow the officer's light as he brings it across your face and into your peripheral vision. The officer will watch your eyes to determine if the eye is twitching at an angle greater than 45 degrees.

Walk and turn — The officer will ask you to walk forward in a straight line nine to 10 steps, turn around and walk back. You may be given further instructions, such as to walk heel-to-toe.

One legged stand — You may be asked to stand with one leg raised roughly six inches. While holding the leg up, you may be required to count aloud until the officer allows you to stop.

Birmingham Lawyer for DUI Testing Errors

If you are in this situation, it is important that you contact an attorney as soon as possible. You may have failed the field sobriety test or even the Breathalyzer, but that does not mean that your case is doomed.

"We will either find a way or make one."

It is not uncommon for law enforcement to make mistakes in the administration of these tests. The attorneys at The Bloomston Firm are skilled in reviewing tape of the stop to find any inconsistencies or instances where law enforcement strayed from protocol.
Where mistakes have been made, the team will file the appropriate motions for evidence suppression.
