Birmingham Second Offense DUI Attorneys

The state of Alabama has recently stepped up its assault on drunk driving, increasing prosecution of repeat drunk driving offenders.

Alabama Second Drunk Driving Charge Lawyers

If you are convicted of your second DUI offense in less than five years, your license will be automatically revoked for one year. This is potentially a total revocation without the opportunity for a work on license. You also face a mandatory minimum sentence of 5 days in jail, spending up to one year in prison, a minimum of 30 days of community service and significant fines. These fines can range from $1,100 to $5,100. Additionally, you will be required to attend substance abuse treatment and rehabilitation programs to address alcohol issues.

If your BAC was .15 or greater, recent changes in Alabama law requires a mandatory minimum sentence of 10 days in prison or 60 days of community service. Potential fines also double to $2,200 up to $10,200.

The potential penalties are stiff, and you may feel that the matter is already doomed. Just because you have been arrested and charged does not mean that your case is already decided. There are possible defenses.

Ignition Interlock Devices — Recent Change to DUI Penalties

Alabama recently enacted laws requiring offenders to have ignition locks installed on vehicles, requiring a passed Breathalyzer test to start the vehicle. Not only are these devices costly and inconvenient, but they also provide embarrassment to drivers. This device will remain in your vehicle for two years if you receive a second DUI conviction in a five-year period.
